Successful strategic land promotion in Allestree, Derbyshire 

Catesby Estates promoted 48 acres of land off Kedleston Road, Allestree, Derbyshire for residential development and community facilities.

The 48 acre site located off Kedleston Road was brought forward through the Court of Appeal and the Supreme Court for new homes following objections by a local action group against new homes on the site

Catesby Estates are pleased to announce that the application to the Court of Appeal has been successful and that planning approval for 400 new homes off Kedleston Road, Allestree, Derby has been reinstated.

The previous decision in the High Court stated that the Inspector had adopted an unlawfully narrow approach to the setting of heritage assets.

The 3 Lord Justices did not agree with this conclusion and allowed the appeal, confirming that the Planning Inspector’s “approach cannot be faulted, and his conclusions were well within the limits of lawful planning judgment.”

A planning application was submitted to Amber Valley Borough Council for 400 homes on the 48 acre site in Allestree in 2014, which was subsequently refused by Amber Valley District Council.  The proposals were subsequently granted planning permission by the Planning Inspector in August 2016, following a two-week public inquiry.

Court of Appeal refuses action group against new homes request August 2018

Kedleston Voice has been refused permission by the Court of Appeal to take their case to the Supreme Court, challenging the decision to reinstate planning permission for new homes in Allestree.

The judgment made by three Lord & Lady Justices at the Court of Appeal back in July ruled in favour of Catesby Estates who plan to deliver 400 new homes on the site off Kedleston Road.

David Morris, Planning Director at Catesby Estates said “It is now clear that the Court of Appeal do not believe that Kedleston Voice have a robust case to pursue.” 

“Their ongoing delaying tactics are denying local people who don’t own a house or are currently on the housing register the chance to find a place to call home.  We hope they reconsider their position moving forward, so that we can deliver much needed housing in Allestree.”

Supreme Court Decision allows 400 new homes in May 2018

The decision made by the Court of Appeal in July 2018 to reinstate outline planning permission for 400 new homes at Kedleston Road in Allestree, has been upheld by the Supreme Court.

The challenge to the ruling was made by Kedleston Voice, a local action group opposed to development on the site. 

They were refused permission to have their case heard in the Supreme Court as the submission did not raise an arguable point of law.

The Court of Appeal rightly upheld the Planning Inspectors conclusions on the impact of the development on the setting of Kedleston Hall, which they described as ‘comprehensive and complete’. The Court of Appeals decision was clear that the Inspectors conclusions in relation to this matter were ‘unassailable’.”

Reserved Matters Planning Application Submitted 2019

Following the granting of outline planning permission for up to 400 homes in August 2016, Catesby Estates submitted a Reserved Matters Application to Amber Valley Borough Council (Ref: AVA/2019/0573). 

Following extensive pre-application discussions, Planning Committee members voted to support the Officer’s recommendation for approval and resolved to grant the application in October 2019.

Strategic land promoted and sold to Miller Homes 2020

Catesby Estates successfully completed the sale of a residential development site in Allestree, Derbyshire to Miller Homes in January 2020.

Fisher German acted for the landowner in the sale of the site.

David Morris, Planning Director at Catesby Estates said, “We have been working on delivering new homes for the area since 2014, which was delayed due to the ongoing legal challenge by the local action group Kedleston Voice, who had their claims rejected by both the Court of Appeal and the Supreme Court.”

“The housing crisis in the UK is well recognised, with the government looking to deliver more homes. Unfortunately, this site is a prime example of how difficult and lengthy the process of new home delivery can be, despite being located in a sustainable area where there is a shortage of housing, particularly affordable homes.”
